1. Who we are
These terms govern the use of the simonlacroix.net website, published and operated by Simon Lacroix, a sole proprietorship registered with the Registraire des entreprises du Québec under NEQ 2274467762 and doing business as “Bonjour la toile” (hereinafter “we”, “our” or “the publisher”).
Business address: 105-3700, rue Évariste-Leblanc, Laval (Québec)
H7V 0C4, Canada. To write to us: the Contact page.
2. Purpose and acceptance
These terms apply to the simonlacroix.net website, as well as to any request for copies of story collections made on the site.
By browsing the site, posting a comment on it or making a request on it, you acknowledge that you have read these terms and you agree to comply with them. If you do not agree, please do not use the site.
You declare that you are at least 14 years old, or that you have the consent of the person having parental authority, and that you have the legal capacity to enter into a contract.
3. Access to the site
Access to the site's content is free and requires no account. We strive to keep the site continuously available, without being able to guarantee it: an interruption may occur due to maintenance work, a technical failure or an event beyond our control.
4. Intellectual property
Unless otherwise indicated, all the elements of the site (texts, short stories, illustrations, visual identities, logos, databases, source code and interfaces) are our property or are licensed to us, and are protected by the Copyright Act of Canada and by the applicable international treaties.
You may view, download and print this content for strictly personal and non-commercial use. Any reproduction, distribution, adaptation, resale or use for other purposes requires our prior written permission.
Third-party trademarks, names and logos appearing on the site remain the property of their respective owners. Their presence on the site implies neither a partnership with them nor their endorsement.
5. Editorial content
Our content is produced for general information purposes. We write it with care and update it periodically.
6. Requests for copies of story collections
The site offers print copies of short story collections. The price of each collection is displayed in Canadian dollars on the request form. Two delivery methods are offered: shipping by mail, with autographed copies and shipping costs charged only once per request; or pickup in Laval, with no shipping costs.
Before confirming, you review the summary of the request and of its amount. The price and costs applied are those displayed at the time of your request. After confirmation, you receive by email the amount, the Interac e-Transfer address and the reference to enter as the transfer message. The site collects no money: the transfer goes directly from your financial institution to ours, and no card or account number passes through the site.
The request moves forward once we receive the payment: the copies are then shipped by mail, or you receive the pickup address and the available times to come and get them. An unpaid request does not reserve any copy. A tracking page, whose address is sent to you by email, shows the status of your request.
7. Legal warranties
If you are a consumer within the meaning of the Quebec Consumer Protection Act, you benefit from the legal warranties provided by that Act, including the warranty that the goods conform to their description and are fit for the purpose for which they are intended.
No provision of these terms may exclude, limit or reduce these legal warranties, which apply in addition to any conventional warranty we may offer.
8. Content you entrust to us
The site allows you to entrust content to us: blog comments, messages. You remain its owner. You grant us the licence needed to host, display and transmit it for the purposes of the service, and nothing more. Comments are published after moderation.
You warrant that this content does not violate any third-party right or any law. We may remove, without notice, any content that is manifestly unlawful, misleading or harmful, and we respond to copyright-based takedown requests sent through the Contact page.
9. Acceptable use
By using the site, you agree not to:
- violate any applicable law or the rights of a third party;
- extract our content on a large scale, in particular through automated scraping, or attempt to reconstruct our databases;
- query the site or its application programming interfaces at a rate that degrades its operation for others;
- disrupt the operation of the site, circumvent its security measures or access it without authorization;
- transmit malicious code, spam or unlawful, defamatory, hateful or misleading content;
- impersonate any person or organization.
We may suspend or terminate your access, without notice, if you breach these rules.
10. Links to third-party sites
The site links to resources operated by third parties. These links are provided for convenience: we have no control over these sites, their content, their business practices or their handling of personal information, and we assume no responsibility for them. We invite you to review their own terms.
11. Limitation of liability
To the extent permitted by law, we cannot be held liable for indirect, incidental or consequential damages (including loss of profits, customers, data or business opportunities) arising from the use of or the inability to use the site, or from the use of an idea or information published on it.
Our total liability relating to a request for copies of story collections is limited to the amount you actually paid for that request.
These limitations do not apply in the case of gross or intentional fault, nor to the extent that they would be prohibited by the Consumer Protection Act or by any other provision of public order.
12. Personal information
The processing of your personal information is described in our privacy policy, drafted in accordance with Quebec's Act respecting the protection of personal information in the private sector and the Personal Information Protection and Electronic Documents Act (PIPEDA).
13. Changes to these terms
We may amend these terms at any time. The version applicable to a request for copies of story collections is the one in force when you confirm it. The effective date appears at the top of this document.
14. Governing law and jurisdiction
These terms are governed by the laws in force in the Province of Quebec and by the federal laws of Canada applicable therein.
Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of the judicial district of Laval, Province of Quebec. If you are a consumer, this clause does not deprive you of the right to bring the matter before the court of your place of residence where the law allows you to do so.
15. Language
In accordance with the Charter of the French Language, the French version of these terms is the official version.
